Chris Brown was in the courtroom for us today. It was all Darl McBride today, and there also was some sparring over SCO expert, Christine Botosan, he reports. It looks like the jury will be hearing about Judge Dale Kimball's ruling after all, because Novell intends to ask her about what happened to the stock when he issued his rulings. And there will be more Darl tomorrow.

Today at the SCO v. Novell trial, Novell called Gregory Jones, and then SCO called Jack Messman as a hostile witness. His deposition was played in part earlier, but this was Mr. Messman testifying live. Finally the Michael DeFazio deposition video was played. Only two more days, and then it goes to the jury.

Chris Brown attended the jury trial today for us in SCO v. Novell, and he has the details about the mistrial motion, the denial of the motion to allow evidence, and there was testimony today from Kim Madsen and Darl McBride and a deposition played of Steven Sabbath. The mistrial was related to the denial of Novell's motion to allow evidence.

They played videos in court today, day 4 of SCO v. Novell's jury trial. SCO claims it has a surprise witness, like that surprises anyone that has been following SCO's legal ways. There was a dispute about that, but I gather it will happen eventually.

Novell's trial brief and proposed jury instructions have been filed in SCO v. Novell. Of course, the parties were asked to try to file the latter jointly, and they have done so a little bit on two instructions, but on others, they couldn't agree so they tell the court they will file separately the rest of the proposed jury instructions. Novell has done so.

SCO v. Novell went to the jury today. Judge Ted Stewart said, after the jury left to begin to deliberate, that in all his years on the bench, he's never seen such fine lawyering as in this case. Chris Brown reports that the jury says they will not reach a verdict by today:I've just received word that the jury does not expect to be done by 5pm (it was 4:30 when I got the call, it's 4:45 now).

Today, the jury in the District Court of Utah trial between SCO Group and Novell issued a verdict.
