Judge Robert C. Jones has set a date for oral argument on SCO's recent Motion to Amend/Correct Complaint in the AutoZone case, and he has done so prior to AutoZone having time to file a response. The date is set for August 24 in Las Vegas at 9 AM. I surely hope some of you can attend. Here's the docket entry...

A SCO Trustee, Edward Cahn, wishes to end the case against AutoZone, but the Linux lawsuit stays for now, with or without McBride

Most of the attorneys who are listed as being involved in SCO v. AutoZone have been told that by the court they are in violation of Special Order 109, which is a requirement to participate in the electronic filing system.

As I mentioned earlier, SCO is asking the court [PDF] to let it amend its complaint against AutoZone, which is probably the only way it can go forward unless the appellate court rules in SCO's favor -- and then a jury does too, down the road apiece. We have the motion and the proposed amended complaint as text now.

The stay on SCO v. AutoZone has been lifted, and the case will resume after December 31. We learn this from the minutes of the status hearing that was held on the 22nd, now listed on PACER. I gather from the minutes that SCO asked for the stay to remain in place, which surprises me, but then again, nothing SCO does should surprise me any more.

SCO has been a busy bee, filing a motion to amend/correct its complaint against AutoZone and a motion to amend/correct the protective order in SCO v. IBM.

Novell has filed its Reply [PDF] to SCO's Response Concerning Novell's Notice of Related Proceeding, which asks the new judge now assigned to the Novell case in Utah, Hon. Ted Stewart, to consolidate the two cases, SCO v. IBM and SCO v. Novell, or in the alternative to at least assign the same judge to both, which SCO opposes.
