New York Times sees European Court ruling in the Microsoft antitrust case as a healthy step in the growth of the information economy

In the next seven days, both Microsoft's European Union and United States antitrust cases will reach critical junctures. A routine U.S. hearing tomorrow will likely be anything but routine. Elsewhere, an appeals court will issue a ruling on the validity of Microsoft's adverse antitrust case in Europe.

The European Court made clear that interoperability information should not be kept secret and the agreement shows that Microsoft saw no way to continue its obstruction of interoperability in this area. This establishes a standard which everyone will have to meet from now on,' summarizes Georg Greve, president of the Free Software Foundation Europe (FSFE)..."

In 2004 the European Commission found Microsoft guilty of monopoly abuse in the IT marketplace and demanded that complete interoperability information be made available to competitors. Microsoft objected to this decision and was overruled in September 2007 by the European Court of First Instance (CFI). The CFI found Microsoft guilty of deliberate obstruction of interoperability and upheld the obligation for Microsoft to share its protocol information.

Microsoft Corp. ended more than a decade of antitrust disputes with the European Union by giving consumers a choice among Web browsers.

The European Commission - Directorate for Competition has officially dropped its antitrust charges against Microsoft, after Microsoft agreed to provide users of its Windows operating system a choice of web browsers. Under the new deal, Microsoft will avoid future E.C. fines and, from March, consumers will have a choice of up to twelve other web browsers.

Fresh action in the European Commission's antitrust proceedings against Microsoft: On May 24, the European Court of Justice conducts a hearing on Microsoft's appeal against the fine. FSFE has participated in the case for a decade and will intervene on the Commission's behalf.

FSFE's role in the antitrust case was to ensure that free software developers would be able to use any interoperability information that Microsoft would be forced to publish. After 5 years of work, the last court case was won last year.

Microsoft has dropped two outstanding appeals of European antitrust rulings, following the deal struck with the European Commission at the beginning of this week, the company said in a statement on Wednesday.
