A former Novell partner takes it to court and new material arrives through the Novell-Microsoft antitrust

To date, Novell has had strong usage of its online SUSE Studio Linux appliance development service, with over 250,000 software appliances built. Even with that success, Novell (NASDAQ: NOVL) sees a need to expand the effort with a new SUSE Appliance Toolkit providing an on-premises version of SUSE Studio, as well as a new Lifecycle Management Server to manage appliance updates.

Novell today claimed to have more certified software partners than rival Linux providers. The chest pumping represents Novell’s latest thinly veiled attack against Red Hat. But take a closer look at Novell’s claims and you’ll see why Red Hat may take issue with some of Novell’s statements.

"Not since SCO has there been a company so reviled by the open source community as Novell following its deal with Microsoft.

Novell has filed a Reply [PDF] to SCO's Opposition to Novell's Motion for Conversion. Novell does not mince words. It suggests that the court check SCO's math, not to mention SCO's 22 pages of its "history" of UNIX and its litigation prospects.

They played videos in court today, day 4 of SCO v. Novell's jury trial. SCO claims it has a surprise witness, like that surprises anyone that has been following SCO's legal ways. There was a dispute about that, but I gather it will happen eventually.

When Novell and Microsoft aren't busy making their products interoperable, they're busy suing each other. A federal appeals court has decided that Novell's antitrust claims against Microsoft may continue. The Linux vendor argues that Microsoft used its market muscle to weaken sales of word processing program WordPerfect and spreadsheet app Quattro Pro.
