The court indicted that it had seen no evidence to demonstrate that they contained ‘any intrinsically valuable invention'. The court was, in fact, singularly unimpressed by the ‘innovation' argument, something of a holy-cow in the US. The court quoted arguments from the Free Software Alliance, to the effect that “Microsoft has a policy of adopting pre existing protocols and them making minor or pointless changes to them with the aim of preventing interoperability”. The Commissioner discernibly did not choose to take a conciliatory path,..... “I will not tolerate continued non -compliance', raising the potential for further fines, should Microsoft not fall rapidly into line.
