The court was, in fact, singularly unimpressed by the ‘innovation' argument, something of a holy-cow in the US. The court quoted arguments from the Free Software Alliance, to the effect that “Microsoft has a policy of adopting pre existing protocols and them making minor or pointless changes to them with the aim of preventing interoperability”. The Commissioner discernibly did not choose to take a conciliatory path,..... “I will not tolerate continued non -compliance', raising the potential for further fines, should Microsoft not fall rapidly into line.
