The points made in this article is not news. Msoft is not bound to the GPL3 if they didn't convey any GPL3 software. Also, the patent section of the GPL3 is not specifically aimed directly at Msoft (despite what these pundits believe) but to the computer software industry in general (which includes Msoft).
