This is good news, that Mark Webbink has joined the board of the Software Freedom Law Center. Good news for the FOSS community. For him, I think the idea of a laid back, restful retirement is now just a dream.

Patent Absurdity explores the case of software patents and the history of judicial activism that led to their rise, and the harm being done to software developers and the wider economy. The film is based on a series of interviews conducted during the Supreme Court's review of in re Bilski — a case that could have profound implications for the patenting of software.

In April Groklaw announced it will be shutting down. Now this decision has been reversed and instead PJ has handed the torch down to law professor Mark Webbink. He was General Counsel at Red Hat and he is on the board of the Software Freedom Law Center. So for legal advice on FOSS matters, Groklaw is still the place to go.

There is an article by Mark Webbink, Esq., "Packaging Open Source", in the International Free and Open Source Software Law Review, Vol 1, No 2 (2009) that I think you'll find interesting. It compares various FOSS licenses and how they handle compilations and collective works.

The Open Invention Network, the Software Freedom Law Center, and the Linux Foundation have teamed up to create another tool to defend Linux from patents. It will be hosted by the NYU Peer to Patent folks, where Mark Webbink is now. It is called Linux Defenders, and that would be you, in that they are asking folks to provide prior art to block anyone else from patenting it.

I'm very happy to tell you that it's just been announced that the Peer-to-Patent project, which is a cooperative project between New York Law School and the USPTO, has been extended after the first year's trial. It's also been expanded to include business methods patents! Yum. I can't wait to see you try to invalidate some of those.

"Software patents are evil." Ask almost any free or open source software advocate, and they'll tell you that software patents kill creativity and keep computer science from advancing as rapidly as it would if everyone shared their basic work with everyone else, unencumbered by patents or other restrictions.
